Some companies are so confidant they are going to win that they will bypass an out of court settlement and end up paying thousands or millions of dollars more than they would have in an out of court settlement.
Consider the advantages to both before you accept an out of court settlement for any class action lawsuit. In most cases it is more advantageous if you allow it to go to court in spite of any payments to the lawyer handling your case. Keep in mind that in most cases if you win in court the losing party has to pay the fees including your lawyer.
