When Pharmaceutical Litigation Is Necessary

In spite of government controls on pharmaceuticals, sometimes the pharmaceutical industry does not wish to take responsibility for errors in judgment they make. Sometimes, it is not a matter of people here in the United States, but in countries that have less quality controls in place.

The Internet and Medicine Issues

The Internet makes it easy for consumers to buy products in other countries that have been banned in the United States. Pills such as Phen-fen, an over the counter diet pill that was found to cause heart attacks and other serious side effects, can be purchased online. Nonetheless, the Internet is not the only problem. Problems also arise when manufactures simply decide they don’t care about the safety of consumers. In the case of Phen-fen, for example, the manufacturer was not willing to recall the medication on its own. Rather, it waited until it was forced by the FDA to do so.

Misleading the Public

Like other industries, the pharmaceutical industry is more interested in the money it can derive from consumers than their well-being. We need only look at the length of time it took for Vioxx to leave the shelves to prove this point. Only in the last couple of years have we begun to see the industry paying out class action lawsuits related to the use of this dangerous drug. Nonetheless, many people took it without realizing the true impact it might have on their health. Only now do we know that the choices people made when taking Vioxx were living in pain or dying from its use.

Just When You Thought You Were Safe…

We also know that formula changes had to be made in cold medications such as Sudafed and Dimetapp in order to protect the health of the public. It is only recently we have begun seeing these products on the shelves again after having to secure them from the pharmacy itself. We are now also hearing that some cold medications intended for small children may not be as safe as we originally thought, although this comes to light mostly from overuse by parents. The pharmaceutical industry must not only protect people from production errors and judgment errors in the use of certain medications, however. it must also protect people from themselves.

Failing to Gather All the Facts

It is noteworthy to state, though, that although some medication problems within the pharmaceutical industry involve patient over-dosage, this is not the primary reason for pharmaceutical injury. Rather, the errors that occur during production or simply because the FDA approved a drug without knowing all the facts is often at fault. Sometimes, these mistakes are purposely caused by the medicine companies because, in an attempt to gain approval quickly, they provide inaccurate information about the drug’s benefits and side effects. It may be years before anyone connects a drug’s use with symptoms a patient may have, which was the case with Vioxx.

Pharmaceutical litigation is something that may take many years to develop, so it’s important for consumers to keep close watch on any symptoms they may develop after beginning a new medication. If you cannot obtain assistance from your doctor in identifying any potential risks, by all means contact a lawyer who is experienced in the field of pharmaceutical litigation and will know of any class action lawsuits that may be currently under consideration.
